Zusammenfassung der Projektergebnisse

Das Internationale Graduiertenkolleg (IGK) „Human Rights under Pressure” schuf ein hervorragend vernetztes und interdisziplinäres Doktorandenprogramm an der Freien Universität Berlin (FUB) und der Hebrew University Jerusalem (HUJ). Von rechtswissenschaftlichen Fragestellungen ausgehend, wurde insbesondere mit Partnern der Politikwissenschaft, Philosophie und Geschichtswissenschaft gemeinsam die aktuelle Krisensituation des Menschenrechtsschutzes analysiert. Die Arbeiten des Kollegs haben dabei sowohl klassische rechtswissenschaftliche Arbeiten hervorgebracht, als auch von „law & society"-Ansätzen geprägte Forschungsarbeiten mit hohem methodischen und theoretischem Innovationsgehalt hervorgebracht. Im Mittelpunkt der Arbeit des Kollegs standen dabei Aspekte der Ungleichheit, der Herausforderung von Menschenrechten durch technologische Innovationen sowie auf einer ganzen Reihe von Ebenen die immer wieder kehrende Frage nach den Grundlagen der Menschenrechte und ihrer Kritik. Systematisch strukturiert wurde die Arbeit durch drei thematische Zugriffe, die von Anfang an der Arbeit des Kollegs zugrunde lagen: (1) Menschenrechte in Krisenzeiten und Notlagen; (2) Menschenrechte und Diversität; (3) Menschenrechte und Globalisierung. Die Ergebnisse des Kollegs unterstreichen dabei die Kontextabhängigkeit von Menschenrechtsschutz. Die Forschungsarbeiten des Kollegs haben herausgearbeitet, wie die Umsetzung der oftmals universell konzipierten normativen Ideale des Menschenrechtsschutzes von einer Vielzahl von lokalen Faktoren und Kontextbedingungen abhängt. Menschenrechte sind in ihrer Geltung dabei nicht nur in Krisenzeiten und Notlagen herausgefordert. Die Normativität des Menschenrechtsschutzes ist häufig an und für sich prekär und vielfältigen sowie dabei ebenso notwendig wie potentiell destabilisierenden Politisierungsprozessen ausgesetzt. Diversität ist für den Menschenrechtsschutz eine konstituierende wie ebenfalls potentiell unterminierende Kategorie. Forschungsergebnisse des Kollegs haben insbesondere gezeigt, wie fruchtbare Diversität und problematische Identitätspolitik eng beieinander liegen können. Schließlich sind die Menschenrechte Treiber wie Getriebene aktueller Globalisierungsprozesse. Der Krisendiskurs des aktuellen Menschenrechtsschutzes („backlash“) illustriert dabei, wie Kritik an den völkerrechtlich geschützten Menschenrechten nicht mehr nur auf punktuelle Veränderungen abzielt, sondern eine zunehmende Zahl an politischen und gesellschaftlichen Akteuren das Ideal des Menschenrechtsschutzes als solches in Frage stellt. Die sich hierbei auch für die Wissenschaft stellenden Fragen waren Gegenstand von Forschungsarbeiten und wissenschaftlichen Veranstaltungen, in denen die Stipendiatinnen und Stipendiaten nicht nur mit Akteuren der Wissenschaft, sondern auch der Politik und Zivilgesellschaft in einen engen Austausch getreten sind. Das IGK hat ein internationales Netzwerk von Forschungseinrichtungen und Forscherinnen und Forschern geschaffen, das innovative interdisziplinäre Menschenrechtsforschung ermöglicht hat. Die deutsch-israelische Kooperation bot hierfür besonders gute Voraussetzungen. Das besondere historische Verhältnis der beiden Länder hat das abstrakte Konzept von Menschenrechten mit konkreten Inhalten gefüllt und einen fruchtbaren Dialog ermöglicht. Die Doktorandinnen und Doktoranden erhielten dadurch die Möglichkeit, Menschenrechte aus einer anderen akademischen, politischen, historischen und kulturellen Perspektive zu erforschen. Das IGK stärkte den akademischen Austausch und die Kooperation junger Forscherinnen und Forscher der HUJ und der FUB in ganz beträchtlichem Maße. Eine ganze Reihe von früheren Mitgliedern des Kollegs arbeiten in herausgehobenen Positionen in Wissenschaft und Praxis des Menschenrechts in Deutschland und im Ausland.
